Louisville City Council met in regular session with Mayor-Councilman Zwick presiding.

A Public Hearing was held on the following Ordinances:

There were no comments on Ordinance No. 98-05.

ORDINANCE NO. 98-06 - BEING AN ORDINANCE AMENDING CHAPTER 139.01(F) OF THE ADMINISTRATIVE CODE OF THE CODIFIED ORDINANCES OF THE CITY OF LOUISVILLE

ORDINANCE NO. 98-07 - BEING AN ORDINANCE AMENDING CHAPTER 157.01(A) OF THE ADMINISTRATIVE CODE OF THE CODIFIED ORDINANCES OF THE CITY OF LOUISVILLE

ORDINANCE NO. 98-08 - BEING AN ORDINANCE ACCEPTING THE RECORD PLAT FOR KENYON CREST ESTATES LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF LOUISVILLE, OHIO

Mayor-Councilman Zwick closed the Public Hearing.

Council bowed their heads for a moment of silent prayer followed by the Pledge of Allegiance to the Flag.

COUNCIL MEMBER GRISAK MOVED, COUNCIL MEMBER THORLEY SECONDED, and the Motion carried to approve the Minutes of the March 2, 1998 Council meeting as presented. The vote: All yea.

MAYOR'S REPORT OF RECEIPTS AND DISBURSEMENTS FOR THE MONTH ENDING FEBRUARY 28, 1998

Total Fines $522, Total Forfeitures $743, Total Mayor's Court Costs $133, Subtotal (Court Revenues) $1,398, Total Reparation Rotary Fund $171, Total General Revenue Fund $209, Subtotal (State of Ohio Victims of Crime) $380, TOTAL REVENUE $1,778.

FINANCIAL REPORT OF RECEIPTS AND DISBURSEMENTS FOR THE MONTH ENDING FEBRUARY 28, 1998

Council was presented with a Financial Statement prepared by the Department of Finance indicating the City's financial status for the month ending February 28, 1998.

CITY MANAGER'S REPORT

City Manager Matthew Coppler presented the City Manager's Report which is on file with the City Clerk.

ANNEXATION

Mrs. Miller addressed the Council regarding the possible sale of a 125' x 200' lot contiguous to the City border at the southern and western border of her property contingent upon receiving City services. She indicated there is approximately 548.68' from Police Chief Riggs property which is the last property inside the City limits. Mrs. Miller indicated that her property is zoned agricultural and would like to keep it zoned as agricultural. Mayor-Councilman Zwick asked Mrs. Miller why she doesn't just bring all of the property into the City to square off the City boundaries.

Council Member Grisak commented that this is a large expense to the City to provide services and gain very little in return.

Mrs. Miller indicated that she does not foresee developing any additional lots on the property.

Director of Planning and Development Bob Nau had previously informed Mrs. Miller that to allow this small parcel creates confusion from a safety/service standpoint. He also informed her that the City would be interested in her running her east property line all the way down to the existing corporation limits. Bob also indicated from a property tax standpoint he did not think it matters whether you're in the City in terms of the agricultural designation. The City does have agricultural land in the City.

City Manager Matt Coppler commented the reason the City wants to square off its borders comes from a service delivery aspect. There would be 413 feet of one lane road the Township would have to maintain and 125 feet of City road to be maintained by the City. This would be very difficult for snow removal. If the boundaries were squared off to meet with the contiguous properties, there would be clear definition of what is City and what is Township.

ORDINANCE NO. 98-06 - BEING AN ORDINANCE AMENDING CHAPTER 139.01(F) OF THE ADMINISTRATIVE CODE OF THE CODIFIED ORDINANCES OF THE CITY OF LOUISVILLE

COUNCIL MEMBER MENEGAY MOVED, COUNCIL MEMBER KERCHNER SECONDED, and the Motion carried for the second reading of Ordinance No. 98-06. The vote: All yea. Mayor-Councilman Zwick declared Ordinance No. 98-06 duly passed and enacted.

ORDINANCE NO. 98-07 - BEING AN ORDINANCE AMENDING CHAPTER 157.01(A) OF THE ADMINISTRATIVE CODE OF THE CODIFIED ORDINANCES OF THE CITY OF LOUISVILLE

COUNCIL MEMBER MENEGAY MOVED, COUNCIL MEMBER THORLEY SECONDED, and the Motion carried for the second reading of Ordinance No. 98-07. The vote: All yea. Mayor-Councilman Zwick declared Ordinance No. 98-07 duly passed and enacted.

ORDINANCE NO. 98-10 - BEING AN ORDINANCE ACCEPTING THE FINAL PLAT FOR THE KENYON CREST SUBDIVISION

COUNCIL MEMBER KERCHNER MOVED, COUNCIL MEMBER MENEGAY SECONDED, and the Motion carried for the second reading of Ordinance No. 98-10. The vote: All yea. Mayor-Councilman Zwick declared Ordinance No. 98-10 duly passed and enacted.

ORDINANCE NO. 98-11 - BEING AN ORDINANCE ACCEPTING THE APPLICATION FOR ANNEXATION OF CERTAIN TERRITORY CONTAINING 2.093 ACRES IN NIMISHILLEN TOWNSHIP TO THE CITY OF LOUISVILLE (HILL ANNEXATION)

MAYOR-COUNCILMAN ZWICK MOVED, COUNCIL MEMBER MENEGAY SECONDED, and the Motion carried for the first reading of Ordinance No. 98-11. The vote: All yea.

ORDINANCE NO. 98-12 - BEING AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE STARK COUNTY HEALTH DEPARTMENT FOR MOSQUITO SPRAYING SERVICES

COUNCIL MEMBER KERCHNER MOVED, COUNCIL MEMBER MENEGAY SECONDED, and the Motion carried for the first reading of Ordinance No. 98-12. The vote: All yea.

ORDINANCE NO. 98-13 - BEING AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ADVERTISE, RECEIVE BIDS AND ENTER INTO A CONTRACT FOR THE MAIN STREET RECONSTRUCTION PROJECT

COUNCIL MEMBER GRISAK MOVED, COUNCIL MEMBER MENEGAY SECONDED, and the Motion carried for the first reading of Ordinance No. 98-13. The vote: All yea.

NEW BUSINESS

COUNCIL MEMBER MENEGAY MOVED, COUNCIL MEMBER GRISAK SECONDED, and the Motion carried authorizing the City Manager to issue a tapping license to Wellington Construction, Inc. The vote: All yea.

Council agreed to be panel guests at the May 7th Kiwanis meeting.

COUNCIL MEMBER GRISAK MOVED, MAYOR-COUNCILMAN ZWICK SECONDED, and the Motion carried for the Council to move into Executive Session for the purpose of discussing employment of a public employee. The vote: All yea.

COUNCIL MEMBER THORLEY MOVED, COUNCIL MEMBER MENEGAY SECONDED, and the Motion carried for the Council to move out of Executive Session. The vote: all yea.

COUNCIL MEMBER THORLEY MOVED, COUNCIL MEMBER GRISAK SECONDED, and the Motion carried to adjourn the meeting. The vote: All yea.
